These Terms & Conditions (hereinafter) of 
Yvonne Rausch, Leitermayergasse 40, 1180 Vienna, Austria.

(hereinafter: Yvonne Rausch) are considered to be contract partner for all orders in the online shop under www.yvonnerausch.com. The customer has the responsibility to view the terms and conditions during the ordering process, print and save them.

1. ACCEPTANCE
By using the site, you agree to be legally bound by all the terms and conditions contained in the Terms of Use Agreement (“Agreement”). Please read these terms carefully. By using this site, you also represent that you are at least 18 years old, or you are at least the minimum legal age to enter into a contract in the jurisdiction in which you are using the site. In addition, when you use any current or future version of the website, you also will be subject to the terms and conditions of this Agreement. Please print a copy of this Agreement for your records. We may, from time to time, modify the terms of this Agreement. When we make changes, we will post those changes here. Your use of the www.yvonnerausch.com site following any such modification constitutes your agreement to the terms of the modified Agreement.

2. CONTRACTING PARTY, LANGUAGE, APPLICABLE LAW
The contracting party is Yvonne Rausch, Leitermayergasse 40, 11800 Vienna, Austria. The contract language is English. Austrian law is applicable, excluding UN convention or contracts for the international sale of goods.

3. PRODUCTS
3.1. All www.yvonnerausch.com products are offered only for private consumer use and not for commercial distribution. We only accept orders that are made via the online store. Orders by fax or letter will not be accepted and will not be processed. Orders by email are possible in special circumstances depending on the order value. In such cases an invoice will be sent to customers via email, which have to be paid in full within 14 days.

3.2. Yvonne Rausch has taken reasonable steps to ensure that the information contained in this web site is accurate; however, all information is provided “as is” without any express or implied warranties. We take all reasonable care to ensure that all product descriptions are correct. Unless otherwise expressly stated, the site contents, products and services are provided on an “as is” basis. 

3.3. Pictures on www.yvonnerausch.com are for reference only and are not legally binding. We take all reasonable care to display our products as accurately as possible. What you see depends on your computer equipment, screen or monitor and we are therefore unable to guarantee that the product images are an accurate representation of the actual product. Please refer to our return policy if you are unhappy with your order.

3.4. The website’s shop features products that are for sale. Products are subject to availability. Once the product is sold out, it will be taken off the website at the earliest opportunity or it will be mentioned accordingly online and may not be available again. If a product you have ordered is out of stock at time of order acceptance, Yvonne Rausch will not be liable for filling that order. If such a situation arises, we will notify you as soon as possible and you will not be charged for the out-of-stock product. 

3.5. Product prices are shown in Euros and include the value added tax (VAT). Product prices shown on the website may change from time to time. As Yvonne Rausch is a small business owner, the the Austrian VAT rule applies:

Additional charges such as taxes, duties, fees, levies, or shipping costs may apply based on the destination.

3.6. The prices displayed at www.yvonnerausch.com do not include shipping costs. If the VAT rate applicable on the date of the order is different from the rate at the time of shipment, that change will be reflected on the invoice without further notice.

Shipping cost calculations are defined in the Shipping&Returns section of this Page and, if we are unable to ship your order in full, there will be no additional charge for partial shipment(s) of the same order.

3.7. If a product or service is listed at an incorrect price due to a typographical error or error in pricing information, Yvonne Rausch shall have the right to refuse or cancel any orders placed for any product or service listed at the incorrect price. Yvonne Rausch will have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Yvonne Rausch will issue a credit to your credit card account in the amount originally charged.

4. CONCLUSION OF CONTRACT
All agreements between Yvonne Rausch and the customer in connection with an order are governed by the terms of agreements. By placing your order you agree to the terms and conditions of this website. Any order placed by you binds you immediately to the terms and conditions of Yvonne Rausch. Therefore, prior to placing your order with us, read carefully and understand the terms and conditions of Yvonne Rausch. Any conditions imposed by the customer, which conflict with the terms of this Agreement are not binding. 

The ordering process is initiated by the customer by placing the online store products in the virtual “Shopping Cart”. Entered data may be changed by the customer until the completion of the order which is achieved by clicking the “Buy” button.
Yvonne Rausch will provide an immediate email acknowledging the order.
After review and acceptance of the order, Yvonne Rausch will send an order confirmation and shipment notification via email which includes a description of the items ordered, and shipment details. Order Invoice should arrive with your order in physical form, if you desire a digital receipt, please send an E-mail to: hello@yvonnerausch.com

5. AGREEMENT ON COSTS OF RETURN, ORDER CANCELATION AND EXEMPTION
5.1. Order cancelation prior to shipment
You may cancel your order within 24 hours of placing the order on the website without penalty. You need to inform us via email at  hello@yvonnerausch.com. Should you wish to cancel your order after 24 hours of placing the order, Yvonne Rausch will charge a 7 EUR administrative fee.

5.2. Order cancelation after shipment
Please refer to Shipping & Returns policy section of this Page.

5.3. Payment/Credits after return
No credit will be issued until the goods are received by Yvonne Rausch. The 14 day return policy applies.

5.4. Exemption
Any returned items that are damaged will not be refunded at full value.

5.5. Return of order

6. DELIVERY
Unless agreed upon prior to shipment, shipment is made from the Yvonne Rausch’s location to the shipping address provided by the customer.

6.1. Normal delivery is expected within 7 to 14 business days after order confirmation unless stated differently in the online store. Occasionally, delivery may take longer due to events beyond our control. Parcels may be delivered with different couriers (postal service, DHL, DPD, UPS, Fedex or GLS) depending on the size and weight of the parcel. In the unlikely event the delivery time by any of our chosen couriers exceeds 60 days, you may cancel your order by contacting hello@yvonnerausch.com for a full refund.

6.2. Ordered items are shipped to the shipping address provided by the customer. The customer must provide us with complete and accurate name and shipping address. Yvonne Rausch is not liable for the delivery of your order to a wrong address or wrong person that has been specified by the customer while placing the order.
If the customer provides us with a wrong address or name, he/she will be held financially responsible for that order.

6.3. Note that the delivery time of your order may vary or take longer during sales or busy periods.

6.4. In case ordered items are out-of-stock and result in shipping delays, Yvonne Rausch will inform the customer directly via e-mail. In such a case, if accepted by the customer, we will ship partial orders. Any resulting additional shipping costs shall not be borne by Yvonne Rausch. 

7. WARRANTY, GUARANTEES AND CUSTOMER SERVICE
7.1. The statutory warranty regulations apply. If the delivered goods are defective, the customer has the right to choose between replacement at no charge or credit for the defective product less shipping costs.

7.2. Deviations in material, quality, color, size, cut or design of the product are unavoidable and no reason for returning a product. Yvonne Rausch works with handcrafted products made from natural materials, so certain deviations in shape or color in comparison to the website’s photographs may certainly arise. Warranty rights do not exist for such variances. However the customer is free to prove that deviations are excessive and bring them to Yvonne Rausch’s attention for consideration.

7.3. Warranty rights are voided if the goods have been altered, modified or damaged by the customer or a third party.

8. COPYRIGHT AND INDUSTRIAL PROPERTY RIGHTS

8.1. The listed trademarks and brand names are the intellectual property of their respective owners. Yvonne Rausch will only display texts, images, photographs, sound and video recordings from other third parties on this website if they have given us specific permission to access and use this content.

The contents of the website under www.yvonnerausch.com, in particular texts, fashion designs, graphics, logos, illustrations, slogans, photographs, images, moving images, sound and video recordings and software are the intellectual property of Yvonne Rausch, unless they are copyrighted by third parties. Reproductions, adaptations, translations and other processing of content, including the use of content are NOT permitted. 

9. LIABILITY
9.1. Yvonne Rausch’s liability shall be limited to statutory provisions except as follows:

9.2. In the event that we are prevented from fulfilling our obligations due to a force majeure or other circumstances beyond our control, we assume no liability. If cases of force majeure or other circumstances beyond our control lead to a delay, we will fulfill our obligations as soon as it is reasonably is possible under the circumstances.
9.3. Yvonne Rausch is not responsible for any losses caused by circumstances beyond its control including, but not limited to, fire, flood, storm, riot, civil disturbance, war, nuclear accident, and terrorist activity. Our maximum liability to you related to your order on www.yvonnerausch.com shall be limited to the total price of that order.

10. PRIVACY
Privacy matters. Yvonne Rausch recognizes the importance of our customers’ privacy and takes the following steps to protect that privacy.

10.1. We don’t share private information. The above statement does not include the privacy practices for partnered sites or for sites visited from links shown on www.yvonnerausch.com.  We encourage our customers to read the privacy statements of those sites, as their privacy practices may differ from ours. This privacy statement applies only to this site and does not necessarily apply to off-site information.

10.2. We save, process and use the personal data you provide on the order form to fulfill the order. Your privacy is of utmost importance to us and your personal information will be stored and safeguarded in our data base. 

10.3. We give some information to the contracted shipping companies for the execution of the order. For the settlement of payment, Yvonne Rausch will transfer the payment data of the customer, if necessary, to the bank or payment service provider of Yvonne Rausch. 

11. PAYMENT
You can pay for your goods in various ways as set out below. Please be aware that we host our website via Hostinger, WordPress & Woocommerce and all payment transactions are undertaken via their platform.

11.1. Credit Card. You will enter your payment details at the time you place your order using a valid credit card (Visa, Mastercard, AmEx, ChinaUnionPay, JCB, Diners, CartesBancaires, Discover, Electron or Maestro). The applicable amount will immediately be reserved on your card but will not be debited until the goods are shipped. Yvonne Rausch reserves the right to check the validity of the credit card, its credit status in relation to the order value and whether the address data of the purchaser is correct. We may refuse orders depending on the result of these checks.

11.2. Bank transfer. In certain circumstances when customers chose to place an order via email and Yvonne Rausch has accepted to proceed with this order, a bank transfer to our bank account may be possible. Yvonne Rausch retains the right to decide which orders are acceptable to handle via email/bank transfer and has the right to refuse customers wanting to handle the order via email/bank transfer without explanation.

In cases where Yvonne Rausch confirms the order to be handled via email/bank transfer, Yvonne Rausch will send a PDF invoice to the customer via email incl. the full order value and the correct bank details. The full amount of the order needs to be paid within 14 days after Yvonne Rausch has sent the invoice to the customer via email. If the customer fails to make the bank transfer within the 14 days, a penalty may be charged depending on the value of the order.

Yvonne Rausch uses Hostinger, WordPress, and Woocommerce. for hosting and designing the website, to provide you with adequate service WordPress receiver, collects and stores any information you enter on our website or provide us in any other way. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information such as payment details (name, email, credit card information).

Woocommerce provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Woocommerce’s data storage, databases and the general WordPress, and/or Woocommerce applications. They store your data on secure servers behind a firewall.  

1. Cookies

Our website uses so-called cookies. These are small text files that are stored on your end device with the help of the browser. They do not cause any damage. We use cookies to make our offer user-friendly. Some cookies remain stored on your end device until you delete them. They enable us to recognize your browser on your next visit. If you do not wish this, you can set up your browser so that it informs you about the setting of cookies and you only allow this in individual cases.
